Animal law issues encompass a broad spectrum of approaches – from philosophical explorations of the rights of animals to pragmatic discussions about the rights of those who use animals, who has standing to sue when an animal is harmed in a way that violates the law, and what constitutes legal cruelty. Animal law permeates and affects most traditional areas of the law – including tort, contract, criminal and constitutional law. Examples of this intersection include:
- animal custody disputes in divorce or separations
- veterinary malpractice cases
- housing disputes involving "no pets" policies and discrimination laws
- damages cases involving the wrongful death or injury to a companion animal
- enforceable trusts for companions being adopted by states across the country
- criminal law – anti-cruelty laws.

Which animal is protected under law?
The law provides for criminal penalties, civil penalties and revocation of permits for violations of the AWA. The animals covered by the Act include dogs, cats, primates and other mammals, but excluding birds, rats and mice.
Simply defined, animal law is the combination of statutory and case law that relates to or has an impact on nonhuman animals. It encompasses companion animals and wildlife and animals used in entertainment, research and ones raised for food.
For animals, having rights is everything. With rights, they would not be trapped, beaten, caged, artificially inseminated, mutilated, drugged, traded, transported, harmed and killed just because someone else profits by it. By granting animals rights, the sum of suffering in the world would reduce dramatically.

There are no American federal laws that deal directly with animal cruelty. However, the federal government of the United States is empowered to enact laws outside of the criminal law power and has enacted legislation in its other capacities.
